If a candidate fails in any 1 subject in the CBSE 10th exams (http://v) , then he/she can re-appear in that subject in the CBSE 10th supplementary exams. If the student is declared as fail in the supplementary exam as well, then he will need to appear for the exam in the next academic year. This means you would need to retake the exam for that particular subject in the following year's board exams. In 2023-24, your child will be eligible to take the CBSE Board exam.
Class 10 students are required to be at least 14 years old regardless of the board, whether it CBSE or ICSE. A student must also turn 14 by December 31 of the year he is taking the exam in order to take the CBSE.
Our calculations show that because your child was born on January 02, 2009, he will be at least 14 years old on December 31, 2023. And he has attained the necessary minimum age at this age.

As per the age criteria proposed by CBSE, for 10th level examination, the student need to be atleast 14 years age on or before 31st of December of the appearing year. As a result, you are eligible for the CBSE 2023 examination as you will be 15 years old with 31st of December, 2023.
